Terms of Service
These Terms govern your access to and use of AdCrunch.
Please read these Terms of Service (“Terms”) carefully before using AdCrunch (“Service”), operated by AdCrunch Inc. (“AdCrunch,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.
1. Definitions
- “AdCrunch” or “Service” means the AdCrunch platform, including its MCP server, web dashboard, API, tools, and any related services.
- “User,” “you,” or “your” means the individual or entity accessing or using the Service.
- “Ad Accounts” means your advertising accounts on third-party platforms (Meta, TikTok, X, Snapchat, etc.).
- “MCP” means Model Context Protocol, the open standard used by the Service to enable AI agents to query your ad data.
- “Content” means any data, queries, reports, or materials you upload, connect, or generate through the Service.
2. Acceptance of Terms
These Terms govern your access to and use of the Service. We may update these Terms from time to time. We will notify you of material changes via email or in-app notice. Your continued use after changes constitutes acceptance of the new Terms.
3. Eligibility
You must be at least 18 years old (or the age of majority in your jurisdiction) and have full legal authority to enter into these Terms. If you are using the Service on behalf of a company or organization, you represent that you have authority to bind that entity.
4. The Service
AdCrunch provides a unified MCP server that allows AI agents (such as Claude, Cursor, or ChatGPT) to securely query live campaign setup and performance data from your connected Ad Accounts.
The Service is provided on a subscription basis and includes:
- Secure OAuth-based connections to Ad Accounts
- Read-only access to campaign data, metrics, creatives, and targeting
- Normalized cross-platform reporting
- MCP endpoint for AI agent integration
We reserve the right to modify, suspend, or discontinue any part of the Service at any time.
5. Ad Account Connections & Data Access
- You authorize us to connect to your Ad Accounts via official OAuth flows using read-only scopes (or the minimum required scopes).
- You are solely responsible for ensuring your use of the Service complies with each ad platform’s terms (Meta, TikTok, X, Snapchat, etc.).
- We do not store your ad account credentials. We only store the OAuth tokens necessary to provide the Service.
- You grant us a limited, non-exclusive license to access, process, and display your ad data solely to provide the Service and improve our product.
6. User Accounts & Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify us immediately of any unauthorized access.
7. Data Ownership & Privacy
- You retain all ownership rights to your ad data and Content.
- We process your data only as necessary to provide the Service and as described in our Privacy Policy (incorporated by reference).
- We will not sell your ad data or use it for marketing purposes unrelated to the Service.
8. Intellectual Property
- The Service, MCP implementation, software, design, and all related intellectual property are owned by AdCrunch or its licensors.
- You are granted a limited, non-exclusive, non-transferable license to use the Service during your subscription.
- You may not copy, modify, reverse engineer, or create derivative works of the Service.
9. Prohibited Uses
You agree not to:
- Use the Service to violate any ad platform’s terms or applicable law
- Attempt to access data from Ad Accounts you do not own or control
- Resell, sublicense, or commercially exploit the Service or any MCP endpoint
- Use the Service for competitive analysis or to build a competing product
- Introduce viruses, malware, or attempt to interfere with the Service
- Overload our systems or engage in excessive automated querying
10. Fees & Payment
- Subscription fees are billed in advance on a monthly or annual basis.
- All fees are non-refundable except as expressly stated in our Refund Policy (if any).
- We may change pricing with 30 days’ notice.
11. Termination
- You may cancel your subscription at any time via your account settings.
- We may suspend or terminate your access immediately for violation of these Terms, non-payment, or if we reasonably believe continued use would cause harm.
- Upon termination, your right to use the Service ends, but Sections 5, 7, 8, 9, 12, 13, and 14 survive.
12. Disclaimers & “AS IS” Provision
The Service is provided “AS IS” and “AS AVAILABLE.”
We do not warrant that the Service will be uninterrupted, error-free, or that data will always be accurate.
Ad platform APIs can change at any time, and we are not responsible for outages or inaccuracies caused by third parties.
13. Limitation of Liability
To the fullest extent permitted by law, AdCrunch’s total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.
We are not liable for indirect, incidental, consequential, punitive, or special damages (including lost profits or data).
14. Indemnification
You agree to indemnify and hold AdCrunch harmless from any claims, losses, or damages arising from:
- Your violation of these Terms
- Your misuse of the Service
- Your violation of any ad platform’s terms
15. Governing Law
These Terms are governed by the laws of [Your Country / State, e.g., Delaware, USA], without regard to conflict of laws principles.
Any disputes shall be resolved exclusively in the courts located in [Your City, Country].
16. Changes to the Service or Terms
We may update the Service or these Terms. Continued use after changes means you accept them.
